Not really a big difference. You can get a DUI just sitting in the car without the keys in the ignition & car is in park. I’ve seen numerous videos of parents passed out from drug use/ prescription pills and their kids are just chilling or crying in the backseat.so this kinda sounds like the same scenario. That’s very strange that someone would even try to justify the facts in this one as it’s putting your own children in danger. You can also have those charges thrown out in court because driving means driving. Sitting in a car drunk isn’t driving. The arresting officer may charge you but it’s unlikely to stick. Regardless I’m against DUI every day of the week. If she had been driving then she deserves to have to book thrown at her. From the descriptions I’ve seen she was not actually driving. Until we know real facts this is all speculation. Regardless, it doesn’t sounds like a series of good decisions… Yeah that's not how the law works at least not in Georgia. Obviously every state has different laws and wording of laws. Situational stuff comes to play as well. In the state of GA, keys in ignition is usually the gold standard court wise. Now with the invent of touch to start, I don't know if GA case law (cases being heard, appealed, ruled on etc....) has caught up with technology or not. I agree just sitting in a car without car running and without keys in ignition would be hard to get a DUI to stick unless eyewitnesses or cameras had her driving into the parking lot. She definitely had to get there somehow. The question would be was she drunk or on the drugs when driving to parking lot. Without exact toxicology results we will have to wait and see if we can figure that out or not. If she was intoxicated in a car even without keys in ignition and the car not running, she could still be charged with public intoxication and child endangerment even if the DUI charges couldn't be held up in court.
